§ 1 Conclation of the Treaty
The presentation of the goods in our online shop is not a legally effective offer, but the customer makes a binding purchase offer by placing an online order. We accept the purchase offer by express order confirmation by e-mail or by delivery of the ordered goods. An e-mail with which we only confirm receipt of the order does not constitute a binding acceptance of the purchase offer.
§ 2 Prices
Our prices are based on the list price valid on the day of conclusion of the contract plus the statutory VAT and are without packaging and transport costs ex works.
§ 3 Payment
Our receivables are due upon delivery of the goods to the customer and payable without deduction in EURO per invoice.
§ 4 Delivery
We are entitled to make partial deliveries – insofar as the customer can reasonably expect – for which we may invoice separately.
§ 5 Claims in the event of defects
If the customer is a consumer, he/she has the legal rights in the event of a defect.
If the customer is not a consumer, the following applies in addition:
Subsequent performance shall be effected at our discretion by rectification of the defect or new delivery.
§ 6 Liability for damages and expenses
We are liable without limitation in cases of intent, gross negligence, lack of a guaranteed quality, personal injury and in accordance with the Product Liability Act.
In the event of slightly negligent breach of essential contractual obligations (in particular the obligation to deliver on time and without defects), our liability is limited to the foreseeable damage typical of the contract.
Our liability for slightly negligent breach of non-essential contractual obligations is excluded.
The above provisions shall apply mutatis mutandis to our liability for compensation of futile expenses.
Section 7 Limitation of claims for defects and compensation
The legal regulations apply.
Section 8 Final provisions
Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected.
We are not obliged and willing to participate in dispute resolution proceedings before a consumer arbitration body.
